Terms of Purchase

A purchase from Binkley Designed provides a PDF plan set for the selected house plan, together with the limited license described below. The price is shown on each plan page and confirmed at checkout.

Ownership. Binkley Designed LLC is and shall remain the sole and exclusive owner of all designs, drawings, plans, elevations, renderings, 3D models, specifications, details, documents, and other materials prepared by Designer in connection with the Project (collectively, the "Instruments of Service" and the "Design"), including all intellectual property rights therein, including copyrights. The Client receives no ownership interest in the Instruments of Service or the Design. Payment of the Contract Price does not transfer any ownership or copyright interest to Client. Client receives only the limited license expressly granted below.

License to Client. Upon full and final payment of all amounts due under this Agreement, Client is granted a limited, non-exclusive, non-transferable license to use the Instruments of Service solely for the construction of one residence at one site selected by Client. This license does not authorize use of the Design for any second or additional project or location without Designer's prior written consent.

Client may provide copies of the Instruments of Service to builders, contractors, trades, design professionals, lenders, engineers, consultants, and permitting authorities solely as necessary for the authorized one-residence, one-site project. Providing such copies does not transfer ownership or grant any recipient an independent license to use the Design for another project or location.

The plans may not be resold or publicly posted, and may not be used for any second or additional residence or location without the written permission of Binkley Designed LLC. Copyright and license notices on the plans must remain intact.

Your purchase includes a PDF plan set only. CAD and Revit files are not included.

• Site-specific engineering is not included unless separately stated in writing.
• Local building-code review is not included unless separately stated in writing.
• Permit approval is not guaranteed.
• The buyer is responsible for determining and obtaining any professional review, engineering, modifications, permits or approvals required for the project location.

After payment is confirmed, your personalized plan PDF is prepared and delivered through a private, expiring download link sent to the email address used at checkout. Plan files are never posted at a public address.

The license that applies to your order is incorporated into your personalized plan PDF, which identifies the buyer, the order number, the plan and the license version.
